1. Who we are and what these Terms cover
These Terms & Conditions ("Terms") govern your access to and use of the Finance Market platform — including the website at financemarket.ae, related sub-domains and any mobile applications (together, the "Platform") and the services we provide through it (the "Services").
The Platform is owned and operated by Hamilton International Mortgage Consultant, a civil company licensed by the Government of Dubai, Department of Economy and Tourism, under Professional Licence No. 748683, authorised to carry on the activities of Financing Broker and Mortgage Consultant, with its registered office at Office 201, Al Masaood Building, 54 Al Maktoum Road, Riggat Al Buteen, Deira, Dubai, United Arab Emirates, P.O. Box 12875 ("Finance Market", "we", "us", "our"). "Finance Market" is a brand and registered trademark of Hamilton International Mortgage Consultant.
By accessing or using the Platform, creating an account, or submitting an enquiry, you agree to be bound by these Terms, our Privacy Policy, our Cookies Policy and our Disclaimers, which together form the agreement between you and us. If you do not agree, do not use the Platform.
2. Our role — important
Finance Market is a licensed Financing Broker and Mortgage Consultant (Dubai DET Professional Licence No. 748683) that operates an online platform connecting you with third-party banks, lenders, insurers and other product providers (each a "Provider").
- In our licensed capacity, we may arrange and facilitate your application to Providers, and provide mortgage consultancy in connection with our licensed activities.
- We are not a bank, lender, finance company or insurer. We do not provide credit, lend money, underwrite insurance, or hold customer funds.
- Any product is offered by, and any decision to approve, decline, price or issue a product is made solely by, the relevant Provider, subject to that Provider's own eligibility criteria, terms, approvals and documentation.
- General information, comparisons and calculators on the Platform are provided for information only and do not constitute investment, tax or legal advice. See our Disclaimers.
Your contract for any financial product is between you and the Provider, on the Provider's terms. We are not a party to that contract and are not responsible for the Provider's products, decisions or conduct.
3. Eligibility
To use the Services you must be at least 18 years old, a resident of the United Arab Emirates (or otherwise eligible for the products you enquire about), and legally capable of entering into a binding contract. By using the Platform you confirm that you meet these requirements and that the information you provide is true, accurate, current and complete.
4. Accounts and electronic acceptance
You may need to create an account to use certain Services. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.
You agree to transact with us electronically. By clicking "I agree", ticking a consent box, submitting an enquiry or otherwise indicating acceptance, you enter into a legally binding agreement, and such electronic acceptance and electronic records are valid and enforceable under Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services. We may record the time and version of the Terms and consents you accept.
5. How the Services work
- You search, compare and select products on the Platform and submit an enquiry or application.
- You provide the information and documents needed to process your enquiry, including KYC documents (such as Emirates ID, passport, visa, salary certificate and bank statements) and financial information.
- With your consent, we share your enquiry and documents with the Provider(s) you select and, where applicable, facilitate credit checks (for example, with the Al Etihad Credit Bureau).
- The Provider assesses your enquiry under its own criteria and contacts you (or contacts us) about next steps, approval, pricing and documentation.
Rates, fees, calculator outputs and quotations shown on the Platform are indicative only, are based on information available to us, and do not constitute an offer or a guarantee of any product, rate or approval.
6. Your responsibilities
You agree that you will:
- provide accurate, complete and up-to-date information, and update it if it changes;
- only submit information about another person (e.g., a co-applicant) if you have their permission;
- use the Platform only for lawful purposes and not to commit fraud or submit false documents;
- not misuse the Platform, including by attempting to gain unauthorised access, introducing malware, scraping data, or interfering with its operation; and
- comply with all applicable UAE laws, including those on anti-money-laundering, cybercrime and electronic transactions.
Misuse of the Platform or the data within it may constitute a criminal offence under Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes.
7. Fees
Using the Platform to browse and submit enquiries is free. We may be remunerated by Providers — for example, through referral fees or commissions when an enquiry we introduce results in a product being taken up.
In addition, for our mortgage brokerage services, a service fee may be payable by you to Finance Market. Where a service fee applies, it is set out in a separate Service Fee Agreement that you sign before we proceed, and (unless that agreement states otherwise) it becomes payable only after your finance facility is disbursed by the Lender. We will always disclose any such fee clearly and in writing before you commit.
We do not collect any payment through the Platform. No card or online payment is taken on the website; any service fee is paid by bank transfer under, and on the terms of, the Service Fee Agreement. Refunds (if any) are governed by that agreement, not by the Platform.
8. Anti-money-laundering and sanctions
We comply with applicable UAE anti-money-laundering and counter-terrorist-financing laws (including Federal Decree-Law No. 20 of 2018) and sanctions requirements. We may carry out, or facilitate, identity verification and screening, and we may refuse or discontinue Services to any person who is subject to sanctions or whom we reasonably suspect of unlawful activity.
9. Intellectual property
All content on the Platform — including the Finance Market name and logo (a registered trademark of Hamilton International), text, graphics, design, software and data — is owned by or licensed to us and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your own personal, non-commercial use. You may not copy, reproduce, distribute, modify or create derivative works from any part of the Platform without our prior written consent.
10. Third-party links, content and Providers
The Platform may contain links to, and content from, third parties, including Providers. We do not control and are not responsible for third-party websites, products, services, content or privacy practices. Any dealings you have with a Provider — including any product you take up — are solely between you and that Provider, on its terms. Your use of a Provider's website or product is governed by the Provider's own terms and privacy policy.
11. Disclaimers and "as is"
The Platform and its content are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, to the maximum extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that information (including rates, fees and product details supplied by Providers) is complete, accurate or current. Please read our full Disclaimers, which form part of these Terms.
12. Limitation of liability
To the maximum extent permitted by applicable law:
- We are not liable for the acts, omissions, products, decisions or conduct of any Provider, or for any contract between you and a Provider.
- We are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, data, goodwill or opportunity, arising out of or in connection with your use of (or inability to use) the Platform or the Services.
- Our total aggregate liability to you for all claims arising out of or in connection with the Platform and the Services is limited to the total fees (if any) you paid to us in the twelve (12) months preceding the event giving rise to the claim or, where you have paid us no fees, to one thousand UAE Dirhams (AED 1,000).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable UAE law.
13. Indemnity
You agree to indemnify and hold harmless Finance Market and its officers, employees and agents from any claims, losses, liabilities and reasonable expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Platform, your submission of inaccurate or unauthorised information, or your violation of any law or third-party right.
14. Suspension and termination
We may suspend or terminate your access to the Platform, in whole or in part, at any time and without notice, including if we reasonably believe you have breached these Terms or any applicable law, or to protect the Platform, our users or Providers. You may stop using the Platform at any time. Sections that by their nature should survive termination (including Sections 9, 11, 12, 13, 16 and 17) will continue to apply.
15. Changes to the Platform and these Terms
We may modify, suspend or discontinue any part of the Platform or Services at any time. We may also update these Terms from time to time. We will post the updated Terms on the Platform with a new "Last updated" date, and where changes are material we will take reasonable steps to notify you. Your continued use of the Platform after an update constitutes acceptance of the revised Terms.
16. Communications
You consent to receive communications from us electronically, including by email, SMS and in-Platform messages, in connection with your enquiries, account and the Services. Marketing communications are sent only where you have separately opted in, and you can opt out at any time (see our Privacy Policy). Telephone calls may be monitored or recorded for quality and compliance purposes.
17. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes), are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The competent courts of Dubai have exclusive jurisdiction, save that we may bring proceedings against you in any other competent jurisdiction where appropriate.
18. General
- Entire agreement. These Terms, together with the Privacy Policy, Cookies Policy and Disclaimers, are the entire agreement between you and us regarding the Platform and supersede any prior understanding.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
- No waiver. Our failure to enforce any right is not a waiver of it.
- Assignment. You may not assign your rights or obligations without our consent. We may assign or transfer these Terms in connection with a reorganisation, merger or sale of our business.
- Language. These Terms are provided in English, which is the governing version. We may publish an Arabic translation in the future for convenience.

20. Governing language
These Terms and Conditions are drafted in English; the Arabic version is provided for convenience only. In the event of any inconsistency between the two, the English version shall prevail.
